The importance of studying international experience in the providing of legal aid is useful for comparative legal analysis of issues that occupy an important place in the science and practice of civil procedural law. Concerning this issue, the importance of researching the implementation of the civil legal aid institute in Australia is useful for deep study of this issue.
In general, researching the problem of providing legal aid, it is necessary to say a few words that some issues of this institution (including civil cases) were studied by Ukrainian scholars, including the following lawyers: V. V. Komarov, G. O. Svitlychna, S. O. Koroed, K. V. Gusarov, I. O. Izarova, N. Yu. Golubeva, S. Y. Fursa, S. S. Bychkova, Y. V. Bilousov, O. I. Popov, T. B. Vilchyk, M. V. Zhushman, O. S. Zakharova, V. V. Masyuk, V. Y. Mamnytsky, V. O. Sviatotska, R. Y. Khanyk-Pospolitak, G. V. Churpita, A. V. Dzhuska, E. Y. Bova, G. V. Galushchenko, R. S. Titicalo, M. V. Stamatina, V. S. Lychko, N. V. Khmelevska, Y. T. Shramko, I. O. Yemets, O. M. Drozdov, V. V. Zabotin, S. S. Kalinyuk, G. I. Gladun, M. R. Arakelyan, D. M. Sibilyov, O. V. Rozhnov and others. It should be noted, the work of K. V. Gusarov, who in the pages of legal literature set out his own views on the issues of providing legal aid in cases considered in civil proceedings of Ukraine on the participation of representatives in the appeal of court decisions [1, p. 309].
It is also worth noting that at the international level, the problems of providing legal aid have been studied by well-known scholars, among them: George Hampel, Elizabeth Brimer, Randall Kune, Robert French, Tom Gray, Tamara Walsh, Heather Douglas, O. M. Vakhtinskaya and other scientists.
Studying the issue of providing legal aid in civil cases in Australia, it should be emphasized that the judicial system of this country is significantly different from Ukrainian.
Concerning the previous information, it is interesting to note the view of M. V. Khvorostyany that the Australian judicial system includes federal courts, state courts, as well as several special courts institutions with clearly defined, very limited functions. Both federal and state courts can hear cases according to both Union and state law [2, p. 206].
Speaking about legal practice in which subjects who provide legal aid in Australia exercise their legal subjectivity, it is important to note that a significant part is occupied by civil and family cases. Among them, a special place is occupied by divorce cases, cases about recognizance of incapable people and other disputes.
Analyzing the issue of providing legal aid in family cases in Australia, it is interesting that in this country there is a separate court that specializes in dealing with family cases, which is called "Family Court of Australia" [3, p. 18]. This court has its own website which contains court decisions on family disputes considered by the court [4].
Reflecting the issues of subjects who provide legal aid (including civil cases) in Australia, the point of view of authors which is highlighted in the legal literature and published at the University of Adelaide (Adelaide, Australia), every advocate is different and it ought not be any other way [5, p. 5].
From this point of view, it is clear that the individualization of lawyers, as well as their authorial approach to strategy and case management is important in the implementation of providing legal aid activities in civil cases in Australia.
Speaking directly about the country Australia where the institution of legal aid is actively functioning and developing (including in civil and family cases), it is worth noting the interesting view of O. M. Vakhtinskaya that the Australian Union is a country with a high level of legal culture and this everything is thanks to High Court directly [6, p. 50].
Thinking about professional activities of lawyers in the providing legal aid in civil and family cases in court proceedings in Australia, it should be emphasized that Part 4 of Chapter 1 of the Federal Court Rules of Australia (2011), which was entitled "Lawyers" regulates an issue of the procedure a participation of lawyers, features of their procedural powers, features of their appointment, and also a number of other norms concerning procedural participation of this subject of court legal relations [7].
As the result, it is worth noting that the judicial system of Ukraine and Australia have differences. At the same time, these differences affect the institution of providing legal aid (including civil and family cases). In our opinion, it is necessary to come to international agreements and conclude a number of legal documents between Ukraine and Australia on the issues of providing legal aid in civil cases. This will be very useful to ensure the exchange of practical experience on the professional activities of subjects of providing legal aid (including lawyers).
